The Products are offered for sale worldwide.
For orders delivered outside metropolitan France, the Customer may be
responsible for customs duties, import duties, local taxes or other
charges imposed by the destination country. These charges are not
included in the purchase price unless expressly stated otherwise and
remain the responsibility of the Customer.
The Customer is responsible for ensuring that the Products may legally
be imported and used in the destination country.
The Products are supplied at the prices displayed on the website at the
time the order is confirmed by the Seller.
Prices are stated in euros and are displayed all taxes included (TTC).
59DNA operates under the French VAT exemption regime applicable to small
businesses. The Seller benefits from the VAT exemption regime for small
businesses. Consumer prices are displayed in euros, all taxes included
(TTC). As VAT is not charged under the applicable exemption regime, the
following wording applies:
"VAT not applicable --- Article 293 B of the French General Tax
Code."
Unless otherwise stated, shipping and delivery costs are not included in
the displayed product prices.
Any applicable shipping costs are communicated to the Customer before
payment and are added to the total amount due.
The Seller reserves the right to modify its prices at any time. However,
the price applicable to an order is the price confirmed by the Seller at
the time the order is accepted.
An invoice will be issued to the Customer in accordance with applicable
French regulations.
The ordering process is currently carried out as follows:
The Customer selects the desired Product on the website.
The Customer contacts 59DNA through the contact form or by email,
specifying the desired model and quantity and, where applicable, any
requested options or custom specifications.
59DNA confirms availability, specifications, price and estimated
manufacturing time.
The Customer receives payment instructions by email.
The order is confirmed once the Customer has accepted the proposed
order and the required payment has been received.
For Products requiring custom specifications, the agreed specifications
will be confirmed in writing before payment and manufacturing begins.
The Customer is responsible for checking the accuracy of the order and
all specifications provided to 59DNA.
Once the order has been accepted and payment received, manufacturing may
begin.
The Seller reserves the right to refuse or cancel an order in the event
of a legitimate reason, including a previous unpaid debt or an
unresolved payment dispute.
The Customer may contact 59DNA by email at any time to request
information concerning the status of an order.
Payment is due in full according to the payment instructions provided by
59DNA.
Payment may be made by:
bank transfer;
PayPal.
Bank details and/or PayPal payment instructions are communicated to the
Customer after the order has been reviewed and confirmed by 59DNA.
An order requiring payment is not considered fully confirmed until the
corresponding payment has actually been received by the Seller.
59DNA will not begin manufacturing or dispatching an order until payment
has been received, unless otherwise expressly agreed in writing.
Deposit and Commencement of Manufacturing
For custom-made or made-to-order products, 59DNA may require a deposit before commencing manufacturing. Payment of the deposit authorises 59DNA to begin preparing and manufacturing the order according to the specifications agreed upon with the customer.
Deposit Policy
Once manufacturing has commenced, the deposit is non-refundable in the event of cancellation by the customer, to the extent permitted by applicable law. This policy reflects the custom nature of the products and the work and materials committed to fulfilling the order.
Nothing in this clause limits any mandatory consumer rights or any right to a refund that may apply under applicable law.
Balance Payment and Dispatch
The remaining balance must be paid in full before the order is dispatched. 59DNA will not ship the products until the full outstanding balance has been received and cleared.
Any shipping charges, customs duties, import taxes or other applicable fees shall be handled in accordance with the shipping arrangements agreed upon with the customer and the applicable provisions of these Terms and Conditions.
59DNA pickups are handcrafted and may be manufactured after the order
has been confirmed.
Unless otherwise agreed in writing, Products are generally dispatched
within 14 days following confirmation of the order and receipt of
payment, subject to availability of the materials required for
manufacturing.
If a longer manufacturing period is required, the Customer will be
informed before the order is confirmed.
The estimated delivery time after dispatch depends on the destination
and the carrier used.
Products are shipped to the delivery address provided by the Customer.
The Customer is responsible for providing an accurate and complete
delivery address.
Unless otherwise agreed, delivery is made by an independent carrier.
The Seller will make reasonable efforts to ensure delivery within the
indicated timeframes. Delays caused by the carrier, customs authorities
or events beyond the Seller's reasonable control may affect the delivery
time.
If the Seller fails to deliver within the applicable legal timeframe,
the Customer may exercise the rights provided by the French Consumer
Code, including the right to request termination of the contract under
the conditions provided by law.
The Customer is encouraged to inspect the parcel and Product upon
delivery and to notify 59DNA as soon as possible of any apparent damage,
preferably with photographs of the packaging and Product.
Such notification does not limit or replace the Customer's statutory
rights under the legal guarantees applicable to the Product.
The Seller remains responsible for the risks of loss or damage until the
Customer physically takes possession of the Product, except where the
Customer has independently chosen a carrier not proposed by the Seller.
Customer-Arranged Shipping
Customers may choose to arrange and pay for their own shipping. In this case, the customer must provide 59DNA with a valid prepaid shipping label or shipping document, including any necessary customs documentation, before the order is dispatched.
The customer is responsible for selecting the carrier, choosing the shipping service and ensuring that the shipping label is valid and suitable for the destination. 59DNA will pack the order appropriately and hand it over to the carrier designated by the customer, in accordance with the agreed shipping arrangements.
Shipping Insurance and Loss or Damage in Transit
Customers arranging their own shipping are encouraged to purchase shipping insurance covering the full value of their order. They may choose the insurer and level of coverage at their own discretion.
Where the customer independently selects a carrier that has not been offered by 59DNA, the risks associated with transportation shall be allocated in accordance with applicable law. The customer is responsible for making any claim against the independently selected carrier or insurer, where applicable. Nothing in this clause excludes or limits any mandatory rights or liabilities that cannot legally be excluded or limited.
Customs Duties, Taxes and Import Charges
For international shipments, the customer is responsible for any import duties, customs clearance fees, import taxes and other charges payable in the destination country, where applicable and to the extent permitted by law.
Such charges are not included in the product price or shipping costs unless expressly stated otherwise. Customers are responsible for checking the import requirements and potential charges applicable to their destination before placing an order.
Ownership of the Products is transferred to the Customer once the
purchase price has been paid in full.
The transfer of risk occurs in accordance with the applicable provisions
of French consumer law.
For distance sales to consumers, the Customer generally has a statutory
right of withdrawal of 14 days, beginning on the day after the
Customer, or a third party designated by the Customer other than the
carrier, takes physical possession of the Product.
The Customer does not have to provide a reason for exercising this
right.
The Customer may exercise the right of withdrawal by sending an
unambiguous statement expressing their decision to withdraw, by email or
post using the contact details provided in Article 1.
A model withdrawal form is provided at the end of these GTC.
After exercising the right of withdrawal, the Customer must return the
Product without undue delay and no later than 14 days after
communicating their decision to withdraw.
Unless otherwise required by law, the direct cost of returning the
Product is borne by the Customer.
The Product must be returned with reasonable care and, where possible,
with its original packaging and accessories.
The Customer is responsible for any reduction in the value of the
Product resulting from handling beyond what is necessary to establish
its nature, characteristics and functioning.
The statutory right of withdrawal does not apply to Products that are
genuinely made according to the Customer's specifications or clearly
personalised, where the applicable legal exception applies.
This exception does not automatically apply merely because a Product is
manufactured after an order has been placed or is handcrafted.
Where a Customer requests specific modifications or personalised
characteristics, 59DNA will inform the Customer before payment if the
resulting Product falls within an applicable statutory exception to the
right of withdrawal.
Where the right of withdrawal applies, 59DNA will reimburse the Customer
in accordance with applicable law.
The refund will normally include the purchase price and, where legally
required, the standard delivery costs paid by the Customer.
The Seller may defer reimbursement until the Product has been returned
or until the Customer has provided evidence of its dispatch, whichever
occurs first.
The Products benefit from the statutory legal guarantees applicable to
consumer sales, including:
the legal guarantee of conformity;
the legal guarantee against hidden defects.
These statutory guarantees apply independently of any commercial
warranty offered by 59DNA.
For new Products, the Customer benefits from the legal guarantee of
conformity for a period of two years from delivery, in accordance with
the French Consumer Code.
Where the legal guarantee of conformity applies, the Customer may
request repair or replacement of the Product, subject to the conditions
and limitations provided by law.
If repair or replacement is impossible, refused, not carried out within
the legally applicable period, or otherwise falls within a statutory
case allowing it, the Customer may be entitled to a price reduction or
termination of the contract in accordance with applicable law.
No contractual provision in these GTC shall limit the Customer's
statutory rights.
The Customer may also rely on the legal guarantee against hidden defects
under Articles 1641 et seq. of the French Civil Code.
An action based on a hidden defect must be brought within two years from
the discovery of the defect, under the conditions provided by law.
In addition to the statutory guarantees, 59DNA provides a lifetime
commercial warranty against manufacturing defects affecting the proper
operation of its pickups.
This commercial warranty applies to the original purchaser and remains
valid for the lifetime of the Product, subject to the conditions below.
The warranty covers manufacturing defects occurring under normal use.
The warranty does not cover damage resulting from:
improper installation or wiring;
incorrect electrical connections;
modification, alteration or disassembly of the pickup;
damage caused by a third party;
physical damage, impact or accidental damage;
misuse or abnormal use;
corrosion or deterioration caused by external conditions;
normal cosmetic wear;
damage caused by installation or modification of the guitar or other
equipment.
Where a warranty claim is accepted, 59DNA may, at its discretion and
subject to applicable law, repair or replace the defective Product.
This commercial warranty is provided in addition to, and does not
replace or restrict, the Customer's statutory legal guarantees.
To request warranty service, the Customer should contact 59DNA by email
and provide the order information and a description of the problem.
Photographs, measurements or other information may be requested to
assist with diagnosis.

is processed directly by an external payment provider.
Personal data may be shared with service providers where necessary to

Personal data will not be used for advertising or marketing purposes
without an appropriate legal basis or, where required, the Customer's
